Question about ethical conduct between patient/provider at a mental health agency.?
My friend is an adult male who is treated by a psychiatrist, at a New Jersey mental health facility, for bipolar and PTSD. In addition to a psychiatrist, my friend has a " case manager" who is supposed to provide structure and help aid clients in their daily lives, such as, assisting in keeping doctor appointments, seeking and maintaining adequate housing and employment opportunities and assisting in crisis management in the event that client becomes episodic. The problem is that my friend's case manager a flamboyantly gay man has been acting strange. He routinely asks my friend to coffee and has also offered to drive my friend home in his personal vehicle after work. My friend says that these offers are often accompanied with flirting from his case manager and although he is not gay, and is a little uncomfortable, he is reluctant to make a " big deal" about it. At first I thought my friend may have been acting conceited like when a guy thinks a girl likes him, but she really doesn't but then I saw him interact with his case manager one day and the guy was being very " touchy feely" with my friend and he seemed to be flirting The final shoe to drop was when my friend told me that his case manager had begun text messaging him. One of the messages said " where is my smart man?" Yesterday, my friend said that his case manager was becoming more forward and he thinks he is going to ask him to dinner. My question is, even though there is reason to believe that some questionable behavior is taking place, does it necessarily rise to the level of ethical miconduct, and should my friend pursue legal action? If it is not unethical, where is the line drawn and when must it be reported? Can my friend pursue legal action? Do the same rules of ethical relationships apply to case managers as to doctors? What if my friend is invited to his case managers house? What should he do? I hate to sound like an ambulance chaser, but I think my friend ought to sue on the basis of principle, but also for some monetary damages. Do you see a case? Can you provide a link to a legal case which may act as precedent for this type of law suit? Please tell me anything that you think would be helpful in strengthening the claim and amassing crucial evidence to support the claim?
